Trial Demonstration of a Low Impact MVA Case

Friday, September 30, 2011

Agenda

See demonstrations of direct and cross examinations of the plaintiff, defendant and treating doctor, and also demonstrations of Opening Statements and Closing Arguments.

In June 2006, the Plaintiff, a 23 year old female, was rear ended on the Post Road in Greenwich, CT while stopped waiting for a vehicle in front of her to turn left. There was relatively minimal property damage to the rear of her vehicle. The Plaintiff suffered an exacerbation of a prior sprain/strain injury of her neck. A little over one year prior to this collision, in March 2005, the Plaintiff was rear ended by a truck and injured her neck. She was not assigned any permanency following the first collision but did have a cervical epidural injection in December 2005. She was last treated for her neck injury before the second collision in February 2006. MRI of her neck after the second collision was normal. She was assigned a 6% impairment of her neck as a result of the second collision. Her medical expenses were approximately $11,000.

Issues in the Case:

  • Minimal Property Damage
  • Aggravation of Pre-existing Injury
  • Mitigation of Damages – Cancellation or No-show to Physical Therapy Appointments
  • Defendant’s Admission of Liability Right Before Trial
  • Active Plaintiff Who Continued Her Lifestyle and Activities
